Real Estate Litigation

Property Line Encroachment

Richard's clients prevailed at trial. Attorney fees and costs recovered.

Homeowner vs. HOA

Specific Performance

Richard's clients backed out of a sale after the buyer was unable to obtain financing within a reasonable time period. Richard defeated the buyer's attempts to obtain specific performance after a binding arbitration.

     Rescission 

Richard's client purchased a home from a seller who concealed extensive vandalism by the prior occupant. Richard sued the seller and took the case to binding arbitration. The arbitrator found the seller had defrauded Richard's client, and ordered that the contract be rescinded. Richard's client received all of her money back, including attorneys fees and costs. 

Admitted liability by Richard's client. Richard succeeded in keeping jury award below the pretrial settlement offer.

Richard's client prevailed after a six week jury trial.

Fist fight

Richard represented men who were accused of starting a fist fight and injuring two plaintiffs. The jury found Richard's clients not liable after a three day trial.

Construction

Defective Windows

Richard successfully defended the window manufacturer at trial.

Soils subsidence

Richard successfully defended the owner of a large tract of land against allegations of destruction of sub-adjacent support.

Defective Construction

Richard represented the owner of a commercial office building in a suit against the general contractor for construction defects and defective grading and compaction. Richard's client prevailed after a 19 day jury trial. Attorney fees and costs awarded.

Denial of Coverage

Richard prevailed after a bench trial proving that the insurer should have provided coverage for his client's claims.
